- Eligibility:
This creative advertisement contest (“ADXiaomi”)
is open to all postgraduate students currently enrolled in
business colleges and undergraduate students currently enrolled in
engineering colleges (“Students” or
“You”), in India (“University”),
and is being held by Xiaomi Technology India Private Limited
(“Xiaomi” or “we” or
“us”).
- You should be an individual legal resident of the Republic of
India.
- You should be enrolled as a student in any year of your course,
at your University.
- You should be aged 18 years or above at the time of entry into
the Contest.
- Employees of Xiaomi and its affiliates, their immediate family
members (spouses, domestic partners, parents, grandparents,
siblings, children and grandchildren), and employees of Xiaomi’s
advertising agencies and agencies or partners engaged for
provision of services with respect to the Contest, are not
eligible to participate in this Contest.
- Registration:

- There is no registration fee for the Contest.

Teams of up to three (3) Students can register for the Contest
(each, a “Team”). Students cannot register themselves as part of
more than one team. All Students participating in a Team, are
required to be from the same University, however, they may be in
different specializations or batches.

- Xiaomi reserves the right to check the validity of the
registration information submitted by Students, at any point of
time.

Students would be required to register from the University
provided e-mail ID, to prove that they are currently enrolled as
students in the University, at the time of registration.
Students submitting false information / misinformation during
registration procedure set out in this Paragraph 2, will be
automatically disqualified. Students who do not register from
the University provided e-mail ID shall be disqualified. The
decision of Xiaomi in this regard shall be final and binding.
- Any deviation from the above set out registration procedure by
a Student, will result in immediate disqualification of the
Student and their Team.

Registered Teams will not be permitted to modify the composition
of their Teams, or substitute one Student for another.
- Contest:
Each Team must create a video advertisement on any of Xiaomi’s
products that have been sold after 2020 (“Advertisement”). The
Advertisement shall be for a minimum of 30 seconds and a maximum
of 60 seconds.
- Timelines ::
The registration for the Contest will start on 10(th) June, 2024,
and will be open till 14(th) of June. The Students will be able to
submit their Advertisement entries from 14(th) of June, and only
till 21(st) of June. All Advertisement entries must be submitted
by the Students, within the timelines specified and communicated
by Xiaomi, at the beginning of the Contest. Any Advertisement
entries received outside the prescribed timelines or format, will
not be considered eligible for the Contest.[RP3] [NkN4]
- Advertisement Format:
All Advertisement entries must be submitted to Xiaomi, by
uploading the same on a Google Drive link. Xiaomi should be able
to access the Advertisement entries, and the Students shall not
delete the Advertisement entries from the Google Drive link at any
stage.
- Judging Criteria:
The Advertisement entries will be judged based on creativity,
originality, adherence to the Contest brief provided on 10th June,
2024 at the beginning of the Contest, and overall impact.
- Winning Prizes:
- The winning Team will receive a cash prize of INR 75,000
(Indian Rupees Fifty Thousand), Runner up team will receive cash
prize of INR 50,000(Indian Rupees Fifty Thousand) second runner
up Team shall receive a cash prize of INR 25,000 (Indian Rupees
Twenty-Five Thousand) (collectively, “Prizes”).[RP5] [NkN6]

Further, the winning Team’s Advertisement entry may be posted on
Xiaomi's official LinkedIn page, at Xiaomi’s discretion, subject
to the Advertisement entry meeting Xiaomi’s social media
guidelines.

The winning Team and runner-up Team may also be invited to
Xiaomi’s office premises, at Orchid Block E, Embassy Tech
Village, Marathahalli-Sarjapur Outer Ring Road, Bangalore,
Karnataka (“Premises”), for interaction with
Xiaomi’s personnel. Accommodation and commute for the winning
Team and runner-up Team, to and from the Premises, including
inter-city travel to and from Bangalore, shall be sponsored by
Xiaomi. Any date mentioned herein is subject to change, and the
Terms may be amended and modified in accordance with the same.

Each of the Student in the winning Team or the runner up Team,
will be notified via e-mail, using contact information provided
or collected at the time of registration. The onus is on each
Student of the participating Teams to ensure that the contact
information submitted at the time of registration is correct and
continues to be valid during the Contest. Xiaomi shall have no
liability in the event any notification is lost, intercepted or
not received by a winning Team or runner-up Team for any reason.
If, despite reasonable efforts, each potential winning Team or
runner-up Team does not respond within 30 days of the first
notification attempt, or if the prize or prize notification is
returned as unclaimed or undeliverable to such winning Team or
runner-up Team, such winning Team will forfeit their Prize and
an alternate winning Team may be selected at Xiaomi’s
discretion. If any winning Team or runner-up Team is found to be
ineligible, or if they have not complied with these Terms or
decline the prize for any reason, such winning Team or runner-up
Team will be disqualified and an alternate winner may be
selected. In all cases, the Contest jury’s decision will be
final.
- The Prize awarded to the winning Team or runner-up Team shall
not be transferable.
- Intellectual Property:
By submitting an Advertisement entry, each Team confirms that
their Advertisement entry is their original work and does not
infringe on any third-party intellectual property rights. Every
Student of a Team shall, in case of any claim by a third-party
against Xiaomi, for infringement of intellectual property in their
Advertisement entry, jointly and severally, indemnify Xiaomi
against any claims, losses, damages, penalties, and other
liabilities.
- Use of Advertisement Entries:
- The Students hereby acknowledge that any Advertisement entries
prepared and submitted by them for the Contest, shall have the
same force and effect as if they are “works-for-hire” for
Xiaomi. Xiaomi shall be deemed to be the sole author or creator
of Advertisement entries, and shall consequently exclusively own
rights, title and interest, including but not limited to the
intellectual property rights, in the Contest material(s) and in
any and all Advertisement entries received.
- Xiaomi or any person or entity permitted by Xiaomi in this
regard shall be entitled to use the Advertisement entries
uploaded and / or submitted by Students, including the
Advertisement entry submitted by the winning Team, runner up
Team, or other Teams, or any information in connection with the
Advertisement entry, on any media/platform for future contests,
marketing, publicity and any other purpose, without any
permission and or payment to you.
- You agree to irrevocably and unconditionally waive in favour of
Xiaomi, any rights, including moral rights, right to
identification of authorship, right to limit modification, title
or interests in your Advertisement entries, immediately upon
submission.
- You hereby grant Xiaomi the right and permission or consent to
interview, photograph, videotape, and record you in respect of
the Contest. You waive any right to inspect or approve any
photo, video, film, written copy, or audio tape taken by Xiaomi
or the person or entity designated by it. You further grant to
Xiaomi a perpetual non-exclusive worldwide license to reproduce,
and display copies of oral interviews, conversations and
lectures (including without limitation by film, electronic
media, videotape, or television), and to authorize others to do
the same. All material, including Advertisement entries,
submitted in connection with the Contest (whether written,
audio, electronic or visual form, or a combination of those) or
any photographs, video and/or film footage and/or audio
recording taken of Students are assigned to Xiaomi upon
submission and become the property of Xiaomi exclusively
- Publicity
By participating in the Contest, each Team consents to Xiaomi
using their names, photographs, and any other relevant information
for publicity purposes on various media / platforms such as
newspapers, radio, television, etc. Students shall not raise any
objections, protests or demur to such coverage and use of their
name, voice, likeness, image or illustrations, by Xiaomi. The
consent recorded in for participating the Contest, shall be deemed
to be consent for publicity efforts.
- Privacy
- You acknowledge that the information provided by you for
registering in the Contest or availing the Prize, is personal
information, and you hereby consent to provide this information
to Xiaomi, for the purposes of this Contest. You understand that
you have the right to choose to not provide any information to
Xiaomi, as requested by Xiaomi. However, if you do not provide
any information Xiaomi, you understand that you may not be able
to register for the Contest or avail the Prize.
- Xiaomi shall collect and store your information to comply with
its obligations under law, and deliver the Prize you have won
under the Contest.
- You hereby agree and understand that the terms regarding
sharing, transfer, disclosure, storing and protection of your
information shall be governed by the following policy:

Xiaomi shall use your information only for the purpose as
specified herein.

Xiaomi will not sell your information to third parties.

Xiaomi will only disclose your information under the
following circumstances:
- Where we have obtained your explicit consent;
- for disclosure based on law or reasonable grounds:
including laws and regulations, legal procedures,
litigation, or at the request of the competent
government departments or agencies if the disclosure is
necessary or appropriate for national security, law
enforcement, or other matters of public health and
safety; and
- Xiaomi may share your information from time to time to
with other Xiaomi affiliates.
- Disqualification
- Xiaomi reserves the right to disqualify any Advertisement entry
that does not comply with these terms and conditions. In the
event Xiaomi suspects any Advertisement entry to have been
tampered with, Xiaomi reserves the right to suspend such entries
and Students from participation. If a Student is caught cheating
in the Contest by taking professional help, plagiarizing, etc.,
their Team will be disqualified and this behaviour will be
reported to their University’s management. Xiaomi’s decision
shall be final and binding in this regard.
- Modifications to the competition:
Xiaomi reserves the right to make changes to the Contest,
including the judging criteria and Prize, at any time without
prior notice. Xiaomi reserves the right to terminate, suspend or
amend the Contest, without any notice and for any reason,
including, without limitation, if Xiaomi decides that the Contest
cannot be conducted as planned.
- Indemnity and Limitation of Liability::
- 38. By entering into this Contest, each Student agrees to
indemnify, release and hold harmless Xiaomi and its parent,
affiliates and subsidiary companies, and all respective
officers, directors, employees, representatives and agents from
any liability, damages, losses or injury resulting from
Students’ participation in the Contest and acceptance, use or
misuse of any Prize won, or from any claim, demand or actions,
made by any third-party or, any penalty imposed on Students due
to, or arising out of a breach of these Terms, or for
infringement of intellectual property in their Advertisement
entry, and any reasonable attorneys’ fees incurred by Xiaomi, in
this regard.
- Xiaomi and its parent companies, subsidiary companies,
affiliate companies, advertising and promotional agencies, and
all their respective officers, directors, employees,
representatives and agents disclaim any liability for damage to
any computer system resulting from access to or the download of
information or materials connected with the Contest.
- Jurisdiction:
These terms and conditions are governed by the laws of India, and
any disputes arising out of or in connection with the competition
will be subject to the exclusive jurisdiction of the courts of
Bangalore, Karnataka.
- Miscellaneous:
- Xiaomi shall not be responsible for lost, late, incomplete or
inaccurate Advertisement entries or registration information,
whether caused by you or by way of some technical,
typographical, printing, operation, or equipment errors.
- In the event you have used or employed any robotic, artificial
intelligence or any other programmed methods, for scripting,
editing or otherwise creating your Advertisement entries, your
Advertisement entry shall be voided and shall not be considered
valid for the Contest.
- All correspondence to Xiaomi, with respect to the Contest,
shall be made to its e-mail ID Nikhil1@xiaomi.com, or on any
other e-mail ID that may be listed on the Website. Students are
advised to not provide their details on calls or e-mails from
any other IDs, and Xiaomi shall bear no liability in relation
thereto.

Xiaomi shall not be liable for any loss or damage due to act of
God, governmental actions, force majeure circumstances, or any
other reason beyond its control, and shall not be liable to pay
any monetary compensation or otherwise for the same.

Under no circumstances shall the submission of Advertisement
entries for the Contest, the awarding of a prize, or anything in
these Terms be construed as an offer or contract of employment
with Xiaomi. You acknowledge that you submitted your
Advertisement entries voluntarily and not in confidence or in
trust. You acknowledge that no confidential, fiduciary, agency
or other relationship or implied contract exists between you and
Xiaomi and that no such relationship is established by your
submission under these Terms.

XIAOMI DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES,
EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, AND
NON-INFRINGEMENT OF THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS.
UNDER NO CIRCUMSTANCES, WILL XIAOMI OR ANY OF ITS AFFILIATES,
DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR CONTRACTORS SHALL BE
LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR
EXEMPLARY LOSSES OR DAMAGES ARISING FROM THE CONTEST, UNDER
TORT, COMMON LAW OR UNDER PUBLIC POLICY, EVEN IF SUCH
PARTICIPANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
